Domestic violence laws are well intentioned laws that are far too easily weaponized by women to exact revenge or extract money from men. I believe that mistake #1 is hiring the wrong attorney. Most law abiding men have had little contact with the justice system other than perhaps a traffic violation. Then, when suddenly and unexpectedly faced with a false accusation where you are treated by authorities as if you're guilty and you have to prove your innocence (which is exactly the opposite of how our Constitution says it's supposed to work), you are suspended from your job and maybe even thrown out of your own home without your belongings and you have no idea how to even hire an attorney much less one that is competent and knows DV law. Even your friends can't recommend an attorney because they too are law abiding and have had little to no contact with the justice system, so you hire any attorney willing to take your case (money). The way things are today any man considering marriage or cohabitation should find a competent DV attorney before hand and have him/her on speed dial for that unforeseen, untrue accusation.

My son and his biological father got into a fight, and now my son is charged with a battery by strangulation, but he didn't strangle his Dad, and his public defender isn't doing much for him at all but he has already had an arraignment and I was wondering if he can still apply for a PTI?

Horrible. Just horrible. There is nothing more empowering than reading and learning the local kaws in your juridiction. Preparing your own defense and standing on your constitutionally protected right of self representation. The entire system is a failure if you believe a bar member will defend you better than yourself. But thars what they want you to believe. If theres a domestic involving the police no attorney is going to be able to help you. Prepare to make sure whoever is charging you whether its a person or the county attorney kniw that they must be able to prove all elements of the charge beyond doubt in a jury trial. You are innocent until PROVEN GUILTY BEYOND A REASONABLE DOUBT. If you are guilty , then face the charge. In many cases the legal process is abused, people are able to go into court ex parte and make a claim to get an order of protection with no evidence whatsoever. Be careful. You dont need a lawyer fkr anythjng except complex contracts and protectong intelectual property.

What sort of contract would be neccessary, or suffice as consent? Can a simple written agreement signed by both people in the relationship stand in a court of law as consent? Would that cause the case to be dismissed?

I work for a company in Panama city and am eligible for interlock permit from another state, Yet Florida DMV has not informed me how to get the permit for interlock issued from a judge yet. I do have a pending driving without a license in Panama city but the public defender is not likely going to get me the permit DMV denied me in the first place.

If attorney's had any ethical standards they would work to get rid of "shall arrest" for domestic violence in FL. Cops hate it, citizens hate it, but domestic violence attorney's love it - $$$$.

While during the hardship hearing be careful, do not say that you have driven or consumed or taken any kind of drugs, including alcohol, and that includes a glass of red wine with a steak dinner. Even though, there are other healthful benefits of having a glass of red wine with steak, like reducing arteriosclerosis, don't tell that to the DMV. Is it ok to fib to the DMV? Since they have no qualms about lying to you, I say it's all's fair.
